Public Offer Agreement

for the provision of access to the ApiValidator web service

1. General Provisions

1.1. This document constitutes a public offer by self-employed individual Alexander Sergeevich Kraev, TIN 772616893750 (hereinafter, the "Service Provider"), who provides access to the web service ApiValidator (hereinafter, the "Service").

1.2. The Service is intended for validating JSON responses for compliance with OpenAPI specifications and providing related validation tools.

1.3. In accordance with Article 437 of the Civil Code of the Russian Federation, this document constitutes a public offer. Any person accepting the terms of this offer becomes a Customer (hereinafter, the "Customer").

1.4. Acceptance of this offer shall mean registration in the Service, use of the Service, and/or payment for the Service. Upon acceptance, the offer is considered concluded and has the force of a legally binding contract.

1.5. The Service Provider may amend this offer unilaterally by publishing an updated version on the website. The updated version becomes effective upon publication. Continued use of the Service constitutes the Customer's consent to the updated terms.

2. Terms and Definitions

Service Provider — the self-employed individual providing access to the Service.

Customer (User) — an individual or legal entity that accepts the terms of this offer and uses the Service.

Service (ApiValidator) — a web application for validating JSON responses against OpenAPI specifications.

Subscription — paid access to the extended features of the Service for a defined period.

Personal Account — a protected area of the Service available after authorization, used to manage settings and subscription.

3. Subject of the Agreement

3.1. The Service Provider grants the Customer access to the functionality of the Service in accordance with the selected tariff plan, and the Customer agrees to comply with this offer and to pay for the use of paid features.

3.2. The specific set of available features is defined by the tariff plan published on the Service's website.

4. Registration and Access Procedure

4.1. Registration is carried out by providing an email address.

4.2. The Customer agrees to maintain the confidentiality of their account credentials and not to provide access to their Personal Account to third parties.

4.3. All actions performed via the Customer's account are deemed to be performed by the Customer.

5. Rights and Obligations of the Parties

5.1. The Service Provider undertakes to:

  • provide the Customer with access to the Service according to the selected tariff plan;
  • process personal data in accordance with the Privacy Policy.

5.2. The Service Provider has the right to:

  • modify the functionality of the Service, add or remove features;
  • perform technical work, including work affecting availability, without prior notice;
  • restrict or terminate access in case of violation of this offer;
  • change subscription costs by publishing updated information on the website.

5.3. The Customer undertakes to:

  • comply with this offer;
  • pay for the Service when using paid features;
  • refrain from using the Service for unlawful activities;
  • maintain the confidentiality of their credentials;
  • use the Service as intended.

5.4. The Customer has the right to:

  • use the functionality provided under the selected tariff plan;
  • change or cancel their subscription;
  • send claims and inquiries to the Service Provider.

6. Service Fees and Payment Procedure

6.1. The cost of the Subscription is determined by the selected tariff plan and is indicated on the Service's website in the "Pricing" section.

6.2. Payment is made by non-cash methods through the payment systems available on the website.

6.3. A Subscription may include automatic renewal. If auto-renewal is enabled, charges are made automatically until cancelled by the Customer.

6.4. Auto-renewal may be cancelled by the Customer in their Personal Account.

6.5. Refunds are provided only in cases required by the legislation of the Russian Federation.

7. Limitations, Warranty Disclaimer, and Liability

7.1. The Service is provided on an "AS IS" basis. The Service Provider does not guarantee:

  • uninterrupted or 24/7 operation of the Service;
  • that the Service will meet the Customer's expectations;
  • absence of errors, delays, or technical failures;
  • preservation of Customer data;
  • compatibility with the Customer's hardware or software.

7.2. The Service Provider does not provide any SLA (Service Level Agreement).

7.3. The Service Provider is not liable for:

  • direct or indirect damages, loss of profits, or loss of data;
  • inability to use the Service;
  • consequences of technical failures of third-party infrastructure or external services;
  • consequences of the Customer providing incorrect data.

7.4. The Customer is liable for:

  • all actions performed via their account;
  • compliance with the law when using the Service;
  • protection of their account credentials.

7.5. The total liability of the Service Provider is limited to the amount paid by the Customer for the most recent paid subscription month.

8. Confidentiality and Personal Data Processing

8.1. The only mandatory personal data required is the Customer's email address.

8.2. Personal data is used exclusively for fulfilling this offer.

8.3. The Service Provider applies reasonable measures to protect personal data but does not guarantee absolute security of data transmission over the Internet.

9. Termination of the Agreement

9.1. The Agreement enters into force upon acceptance and remains valid until terminated.

9.2. The Customer may terminate the Agreement at any time by disabling subscription auto-renewal.

9.3. The Service Provider may unilaterally terminate the Agreement in case of the Customer's violation of this offer.

9.4. If the Agreement is terminated due to the Customer's violation, no refunds are provided.

10. Claims Procedure and Dispute Resolution

10.1. All disputes shall first be resolved through negotiation.

10.2. A mandatory claims procedure applies. The review period for a claim is 30 calendar days.

10.3. If a dispute cannot be resolved amicably, it shall be submitted to a court at the location of the Service Provider.
